New sentencing guideline for strangulation and suffocation offences available on the By Lawyers Criminal Offences App
The By Lawyers Criminal Offences App has been updated to include new sentencing guidelines issued by the Sentencing Council for strangulation and suffocation offences. The guidelines apply to strangulation or suffocation and racially or religiously aggravated strangulation or suffocation offences under s 29 of the Crime and Disorder Act 1998 and s 75A of the Serious Crime Act 2015. The offences were created by the Domestic Abuse Act 2021 and came into force on 7 June 2022.
The sentencing guidelines are effective from 1 January 2025. They apply to all offenders aged 18 and over who are sentenced on or after that date.
